Application of this policy
What is personal information
“non-public information”, which consists of ride transaction information and one-on-one communications between you and other users of the InstaRyde Platform; and
“public information”, which consists of all other demographic information.
Collection of personal information
In order to use certain features of our services you must first complete a registration process and establish an account (“Account”). During registration for your Account you will be required to provide basic information such as your name, address and email address and establish a password. InstaRyde will retain this information and associate it with your Account. In addition, to place an order for services, InstaRyde will require that you provide payment information such as credit card numbers and billing addresses and InstaRyde will also acquire your IP address. Credit card information, including the card number, expiry date and security code, is securely collected by us and passed directly to payment processors over a secure socket layer (see the section entitled “WePay” below). Upon successful transfer of credit card data, the information is erased permanently and not retained by InstaRyde in any form.
Information Collected from Drivers wishing to provide their services
If you wish to apply to drive on our web site(s), we will collect Personal Information such as your name, email address, phone number and may collect additional information such as resume and gender, criminal background checks and driving and insurance records.. We use the information collected within this area of the web site(s) to determine your qualifications for the position in which you have applied and to contact you to set up an interview.
Use of your personal information
You acknowledge that InstaRyde may use the following types of personal information about you:
Information you provide us directly: We ask for certain information such as your username, first and last name, birthdate, phone number, e-mail address, vehicle make, model and year, driver’s license number, automobile registration information, and automobile insurance policy, as well as any information you permit us to collect as part of a background check when you register for a InstaRyde ride taker or driver account, or if you correspond with us. You may also provide us with your financial information for purposes of processing a transaction on or through the Service. We may also retain any messages you send through the Service, and may collect information you provide in User Content you post to the Service. We use this information to operate, maintain, and provide to you the features and functionality of the Service, as is further described below.
Inviting a friend to use InstaRyde from the “Invite friends” or “Driver referral” feature: If you choose to use our invitation service to invite a third party to the Service through our “Invite friends” feature, you may directly choose a friend to invite through your mobile device’s native contact list – but we do not require that you import your contacts list to the Service, and we do not retain the information contained in your contacts list. You understand that by inviting a friend to InstaRyde through the “Invite friends” feature, you are directly sending a an SMS text message or an email from your personal accounts and that we are not storing your contact list. In addition, you understand and agree that normal carrier charges apply to communications sent from your phone. Since this invitation is coming directly from your email or phone, we do not have access to or control this communication. If you choose to use our “Driver referral” feature, we will ask you to provide us with certain personal information for a third party so that we can invite them to join the Service, including their first and last name, and email address and phone number. We may retain this information for the purposes of inviting the third party to join the Service and to track the success of the referral feature. Unless the invitee agrees to join the Service, we do not use the invitee’s contact information for marketing purposes, and we do not share such information with third parties. The invitee may contact us at any time to request that we remove his or her information from our records at 425 Alness St, North York, ON M3J
Analytics information. We may directly collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Service. These tools collect information sent by your browser or mobile device, including the pages you visit and other information that assists us in improving the Service. We collect and use this analytics information in aggregate form such that it cannot reasonably be manipulated to identify any particular individual user.
Cookies information: When you visit the Service, we may send one or more cookies — a small text file containing a string of alphanumeric characters — to your computer that uniquely identifies your browser and lets InstaRyde help you log in faster and enhance your navigation through the site. A cookie may also convey information to us about how you use the Service (e.g., the pages you view, the links you click and other actions you take on the Service), and allow us or our business partners to track your usage of the Service over time. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.
Log file information: Log file information is automatically reported by your browser or mobile device each time you access the Service. When you use our Service, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information.
Clear gifs/web beacons information: When you use the Service, we may employ clear gifs (also known as web beacons) which are used to anonymously track the online usage patterns of our Users. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of the Service.
Device identifiers: When you access the Service by or through a mobile device (including but not limited to smart-phones or tablets), we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a universally unique identifier (“UUID”). Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by InstaRyde. A device identifier may convey information to us about how you browse and use the Service. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Service. Some features of the Service may not function properly if use or availability of device identifiers is impaired or disabled.
Location data: When you access the Service by or through a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey to us information about how you browse and use the Service. Some features of the Service, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.
Commercial and marketing communications: We use the information we collect or receive to communicate directly with you. We may send you emails containing newsletters, promotions and special offers. If you do not want to receive such email messages, you will be given the option to opt out or change your preferences. We also use your information to send you Service-related emails (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices). You may not opt out of Service-related e-mails.
You may always choose not to provide personal information, but if you so choose, our products and services may not be available to you. You agree that you are under no obligation to provide us with this information and can access many aspects of our Web sites without providing us any personal information.
We use your email address and Your other personal information to help Us efficiently operate the InstaRyde Platform, to contact You in connection with Your transactions and other activities on the InstaRyde Platform (including, but not limited to, confirmation emails, or important news that could affect Your relationship with InstaRyde), to forward trip information to You from other Users, to forward trip information from You to other Users, and to contact You and others to suggest potential matches. We use Your contact information to find and connect with Your friends (when instructed by You). These types of communications are known as “Operational Communications.” In some cases, Operational Communications may also contain commercial messages, such as banner ads and special offers.
To operate the InstaRyde Platform, including processing Your transactions and supporting Your activities on the InstaRyde Platform, We may share Your personal information with Our agents, representatives, contractors and service providers so they can provide Us with support services such as email origination, receipt or support services, customer relationship management services, and order fulfillment. We require these entities not to use Your information for any other purpose.
By purchasing, or registering or making reservations for, products or services offered or sponsored by third parties on the InstaRyde Platform, or electing to receive communications (such as emails or material by mail) or electing to participate in contests, sweepstakes or other programs (such as discount or rewards programs), offered or sponsored by third parties on the InstaRyde Platform, You consent to Our providing Your personal information to those third parties. Those third parties may use Your personal information in accordance with their own privacy policies. You will need to contact those third parties to instruct them directly regarding Your preferences for the use of Your personal information by them. Additionally, You agree that We may use and disclose all such information so submitted to such third parties in the same manner in which We are entitled to use and disclose any other information You submit to Us. Any third party with whom We are allowed to share Your personal information is authorized to use Your personal information in accordance with Our contractual arrangements with such third parties and in accordance with their own privacy policies, over which We have no control, and You agree that We are not responsible or liable for any of their actions or omissions. Those who contact You will need to be instructed directly by You regarding Your preferences for the use of Your personal information by them.
How We Use Demographic Data
Please note that information submitted to the Services via a “contact us” or other similar function may not receive a response.
Disclosure of your personal information
InstaRyde may disclose your personal information with your prior consent;
InstaRyde may be required by law to disclose personal information without your consent in the event of emergency situations or when required by government or other legal authority;
As a Passenger, when you sign up for a ride, we will share your username, “star rating,” pick up and drop-off addresses, and phone number with the Driver. As a Driver, we will share your photograph, a photograph of your vehicle, “star rating”, first name, last initial, vehicle make, model, and year, and phone number with the passenger you will be picking up.
How to opt-out / withdraw consent
You can withdraw your consent for the use of your personal information at any time by deleting your Account. Information may be retained by InstaRyde for audit or archival purposes or as required by applicable federal and provincial laws.
If you do not wish to receive marketing communications, you may follow the “unsubscribe” instructions included within each e-mail communication or by selecting or deselecting (depending on the service) the appropriate option in your Account settings. Please keep in mind that, even if you choose not to receive marketing communications, you will continue to receive transactional or account communications related to services or products that you have requested (e.g. purchase confirmation e-mails and receipts).
How long we keep Personal Information
InstaRyde maintains information about you for as long as we provide service to you, and longer for related business activities. After information is no longer necessary for our business purposes, we destroy the information unless there is an outstanding request or order to preserve the information.
Safeguards we have in place
InstaRyde stores and process your personal information on our computers principally in Canada as well as internationally. InstaRyde employs reasonable managerial and technical measures to ensure that your personal information is secure. In addition, our dedicated team of information technology professionals works to maintain data accuracy and prevent unauthorized access to sensitive information. Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of your personal information and cannot assume liability for improper access to it. The Internet is not a secure medium and you acknowledge and agree that the privacy of your e-mail communication and personal information can never be guaranteed as any e-mail communication may be lost, intercepted or altered. By using our Web sites, or providing personal information to us through any means, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Web sites and our services.
YOU MUST BE EIGHTEEN (18)YEARS OR OLDER TO ACCESS THE SERVICES. IF YOU ARE UNDER EIGHTEEN YEARS OF AGE, YOU ARE NOT PERMITTED TO ACCESS THE SERVICES FOR ANY REASON.
Access to your personal information
You are responsible for updating and maintaining the truth and accuracy of the personal information you provide to us relating to your Account. If you want to update the personal information, you have provided to us, you should do so by visiting the “View Profile” section of the app. You must be signed in to access your Account.
There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In addition, the personal information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices. If we do not provide you with access to your personal information, we will endeavour to inform you of the reasons why, subject to any legal or regulatory restrictions.
Collection of non-personal information
We will endeavor to answer your questions and advise you of any steps taken to address the issues raised by you.
Our Web sites are connected by “hyperlinks” to other websites. You acknowledge and agree that InstaRyde makes no representation, warranty, covenant, or claim regarding, and InstaRyde expressly disclaims and denies any responsibility or liability for, directly or indirectly, the privacy practices on any third-party website or resource accessible by hyperlink from our Web sites. You agree that the inclusion of any such hyperlink does not suggest, represent, warrant, covenant or imply that InstaRyde monitors, endorses or exerts any control over such website or linked resource whatsoever. You agree that InstaRyde provides these hyperlinks to you only as a convenience, and the inclusion of any hyperlink does not suggest, represent, warrant, covenant or imply affiliation, endorsement or adoption by InstaRyde of any such website or linked resource whatsoever.
When you leave our Web sites, you acknowledge and agree that our terms and policies do not govern your access to, and use of, other websites. You acknowledge our recommendation to review the applicable privacy and data gathering practices, of any website or linked resource to which you navigate from our Web sites.
All charges, as applicable, shall be facilitated through WePay, Inc., InstaRyde’s third-party payment processing service. You agree that if the transfer fails (due to a typo in the bank details, for example), it can take up to five business days for WePay to be notified. You agree that any mandatory amounts (damages) charged following a ride (a “Charge”) are due immediately.
You acknowledge and agree that InstaRyde makes no representation, warranty, covenant, or claim regarding, and InstaRyde expressly disclaims and denies any responsibility or liability for, directly or indirectly, the privacy practices in regard to any personal information that we disclose on your behalf or you provide to WePay directly or any other party in relation to purchasing a product or service from our web sites.
You acknowledge and agree that our terms and policies do not govern any other party. You acknowledge our recommendation to review the applicable privacy and data-gathering practices of any third party to which you provide personal information.
Any services provided by InstaRyde is controlled and operated by us from Canada, and we do not intend that our services subject us to the laws or jurisdiction of any state, country or territory other than that of Canada. We do not represent or warrant that the services, or any part of the services, are appropriate or available for use in any particular jurisdiction. Those who choose to access the services do so on their own initiative and at their own risk and are responsible for complying with all local laws, rules and regulations. We may limit the services’ availability, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion.
